Our job is to provide legal services to contractors and tradesmen who perform work for Florida homeowners and businesses. Florida homeowners often deal with water/fire/mold damage as a result of wind, rain, hail, plumbing leaks, broken water lines, roof leaks, sewage backups or other similar events which require emergency repair work . Often, this work is covered under an insurance policy. Services such as water extraction, mold remediation, mold testing, fire remediation, plumbing repairs, and/or roof repairs are services that must be performed immediately to mitigate the damage to the insureds property. The homeowner/businessowner is required to do this emergency repair work under the insurance policy under the loss mitigation provision. Therefore, the insureds contact our clients who safely and reliably perform work mitigating the loss and complying with the obligation under the policy. If the homeowner has the ability to pay for the estimated repairs, the contractor can opt to obtain a signed contract with the homeowner and collect directly from them.
Alternatively, if the homeowner is unable to pay for the services, the contractor can review coverage in the homeowner’s insurance policy. The contractor may then ask for an assignment of benefits solely for the right to collect for the mitigation services performed. This document, accompanied with other documentation, allows our client to collect directly from the insurance company and recover for the services they performed for the benefit of the insured and the insurance company. Ideally, our clients coordinate with the insurance company’s adjuster, make the necessary repairs, file the claim and receive fair payment for the work that they performed. In many circumstances the insurance company will rightfully honor the assignment of benefits and pay the contractor what is owed. Unfortunately, in some instances the insurance company is not willing to pay the claim so easily, forcing the contractor to seek an alternative way of collecting for the work.
In that instance the contractor will hire us to file suit to collect for the services performed. As long as the proper procedures are followed, this can be an effective and efficient way to get paid. Our goal is to obtain a cheap, fast, and pain-free settlement for our clients. By allowing us to fight the insurance company or the homeowner when a dispute arises, it frees our clients up to continue their work and spend less time fighting to collect their money for the work that they preformed .
